1) Scope of Application
1.1 These General Terms and Conditions (hereinafter “GTC”) of Jules Beckman, trading as “Digital Empire” (hereinafter “Seller”), apply to all contracts for the delivery of goods that a consumer or entrepreneur (hereinafter “Customer”) enters into with the Seller regarding the goods displayed in the Seller’s online shop. Any conflicting terms and conditions of the Customer are hereby rejected unless expressly agreed otherwise.
1.2 For the purposes of these GTC, “consumer” means any natural person entering into a legal transaction for purposes predominantly outside their commercial or self‑employed professional activity.
1.3 “Entrepreneur” within the meaning of these GTC is a natural or legal person, or a legal partnership, who acts in the exercise of their commercial or self-employed professional activity when concluding a legal transaction.
2) Conclusion of Contract
2.1 The product descriptions in the Seller’s online shop do not constitute binding offers by the Seller, but rather serve for the Customer to submit a binding offer.
2.2 The Customer can make the offer via the online order form integrated into the Seller’s shop. After the Customer places selected goods in the virtual shopping cart and proceeds through the electronic ordering process, clicking the button concluding the order constitutes a legally binding offer for the goods in the cart.
2.3 The Seller may accept the Customer’s offer within five days by:

sending a written order confirmation or confirmation in text form (fax or email), with the date of receipt being decisive; or
-
delivering the ordered goods, with the date of receipt being decisive; or
-
requesting payment from the Customer after they’ve placed the order.
If multiple options occur, the contract is concluded when the first one happens. The five‑day acceptance period begins the day after the offer is sent by the Customer. If not accepted within that period, the offer is considered rejected, and the Customer is no longer bound.
2.4 If PayPal is chosen as the payment method, the payment is processed via PayPal (Europe) S.à r.l. et Cie, S.C.A., Luxembourg, under PayPal’s Terms of Use. If the Customer has no PayPal account, the non-account payment terms apply. By choosing PayPal and clicking the final order button, the Seller accepts the offer at that moment.
2.5 If Amazon Payments is chosen, the payment is processed via Amazon Payments Europe s.c.a., Luxembourg, under its usage agreement. By choosing Amazon Payments and completing the order, the Customer simultaneously authorizes Amazon to pay, and the Seller accepts the offer at that moment.
2.6 Upon submitting an offer via the online form, the Seller stores the contract text and sends it to the Customer in text form (e.g. email, fax, letter). No further access to the contract text is provided.
2.7 Before final submission, the Customer can correct any input errors via the screen’s standard keyboard and mouse functions until they click the final button.
2.8 The contract is exclusively concluded in German.
2.9 Order processing and contact are generally via email and automated systems. The Customer must ensure their provided email address is accurate and can receive messages, including ones from third parties via spam filters.
3) Right of Withdrawal
3.1 Consumers are generally entitled to a right of withdrawal.
3.2 Detailed information on the right of withdrawal is provided in the Seller’s withdrawal policy.
4) Prices and Payment Terms
4.1 Unless stated otherwise, the listed prices are total prices. VAT is not shown since the Seller is a small business under German VAT law. Any additional shipping costs are shown separately.
4.2 Available payment methods are communicated in the Seller’s shop.
4.3 If prepayment by bank transfer is agreed, payment is due immediately after contract conclusion unless otherwise agreed.
4.4 If PayPal is selected, payment is handled via PayPal, which may assign further payment providers. If the Seller offers deferred payment methods via PayPal (e.g. invoice or installment), PayPal conducts a credit check and may refuse based on results. Payments must then be made to PayPal or its agent.
4.5 If SOFORT is selected, payment is processed via SOFORT GmbH, requiring an eligible online‑banking account and confirmation by the Customer.
4.6 If “Shopify Payments” is used, payment is handled by Stripe Payments Europe Ltd., Dublin, which may also use third‑party services under their terms.
4.7 If “VR Payment” is selected, payment is handled by VR Payment GmbH, Frankfurt, which may also use third‑party providers under their terms.
5) Delivery and Shipping Conditions
5.1 If the Seller offers shipping, delivery is made within the specified delivery area to the Customer’s provided address unless agreed otherwise.
5.2 If delivery fails due to reasons attributable to the Customer, the Customer bears the reasonable costs. This does not apply if the right of withdrawal is exercised. Return shipping costs are governed by the withdrawal policy.
5.3 For entrepreneurs, risk passes once the goods are handed over to the carrier. For consumers, risk passes upon delivery, except if the Customer chose the carrier themselves without the Seller naming them first—then risk transfers when handed over to that carrier.
5.4 The Seller may withdraw from the contract if self-supply fails, despite due diligence in sourcing. The Customer will be informed and refunded.
5.5 Pickup by the Customer is not possible for logistical reasons.
6) Retention of Title
The Seller retains ownership of the delivered goods until full payment is received.
7) Liability for Defects (Warranty)
7.1 Unless otherwise stated, statutory liability for defects applies.
7.2 For entrepreneurs:

The Seller may choose the type of remedy;

A 1-year limitation period applies to new goods;
-
No claims for used goods;
-
Replacement does not restart the limitation period.
7.3 For consumers: -
A one-year limitation may apply to used goods if agreed and the Customer was informed prior.
7.4 These limitations and shorter periods do not apply to: -
claims for damages or compensation;

deliberate concealment of defects;
-
defects in goods used in buildings;
-
obligations to provide updates for goods with digital elements.
7.5 For entrepreneurs, statutory recourse rights remain.
7.6 Merchant customers must inspect goods and notify defects per § 377 HGB, or goods are deemed accepted.
7.7 Consumers must report visible transport damage to the carrier and Seller—failure doesn’t affect legal or contractual rights.
8) Applicable Law
The law of the Federal Republic of Germany applies, excluding international sales law. For consumers, mandatory laws of their country of residence remain unaffected.
9) Alternative Dispute Resolution
9.1 The EU Commission provides an online dispute resolution platform at ec.europa.eu/consumers/odr.
9.2 The Seller is neither willing nor obligated to participate in dispute resolution before a consumer arbitration board.
